Toilets

  1. The Toilets are self sufficient with their own sewer holding tank,
  2. Each Toilet has a water tank for fresh water flushing and washing of hands
  3. They also have solar powered fairy lights in the roof for lighting. These lights turn on automatically when it gets dark.
  4. The Toilets can be placed anywhere and do not require any services from the property
  5. The Toilets are lined inside in white to keep them clean and hygienic.
  6. The Toilets are supplied with eco hand soap, hand towel, toilet paper and a deodoriser. 

Showers 

  1. Showers have their own portable hot water service operating from an LPG bottle which is supplied.
  2. At the venue you will need a hose tap to supply water for the shower and a sewer connection point to discharge waste water into. 

Terms and conditions of rental.

DEFINITIONS

 ‘Company’ means Lloyd Family Trust Pty Ltd trading as Paddock Dreams Amenities.

‘Client’ is the person hiring the Equipment from the Company.

‘Equipment’ is the equipment and other materials specified on the Run Sheet and nothing else.

‘Period of Hire’ is the period between completing the set up of the Equipment and beginning the dismantling.

‘Hire Charge’ is the amount payable by the Client to the Company as specified on the Invoice.

‘Run Sheet’ is the form issued by the Company to the Client containing details of the Equipment, Period of Hire, Handover Acceptance and post event Equipment Condition Report.

‘Invoice’ is the invoice or invoices issued by the Company to the Client in relation to the Run Sheet.

‘Security Deposit’ is required up front per booking. Once paid the booking is secured.

‘Full Balance’ is due 28 days prior to your event date.

‘Third Party Supplier’ is a company or individual not owned directly by the Company and shall not form any party of a contractual obligation between the Company and the Client.

‘Third Party Equipment’ is equipment owned, maintained and supplied by a Third Party Supplier. 

All such equipment shall not be the responsibility of the Company.

  1. CONDITIONS

    Unless stated in writing all orders are accepted subject to the Terms and Conditions of hiring stated below and the Client by authorising or allowing work to proceed is deemed to have acknowledged this. 

  2. THE COMPANY UNDERTAKES:
    1. To deliver the Equipment and proceed to erect it on or before the Set Up date shown on the Run Sheet.
    2. To dismantle and remove the Equipment from the site on or after the Dismantling date shown on the Run Sheet. 
  3. THE CLIENT UNDERTAKES:
    1. To pay the Deposit and to pay the Balance in accordance with the Invoice.
      The Company reserves the right not to provide the Equipment should payment not be received. 
    2. To pay interest on all monies outstanding at the rate of 4% per annum above the base rate of the ANZ Bank.
    3. To provide the Company with either a plan showing the position in which the Equipment is to be erected and all underground services and any apparent obstacles or to make available a representative on the site for that purpose. In the absence of both then the Company having erected the Equipment where it thinks fit shall be deemed to have completed the contract. In any event, the Client and not the Company will be responsible for any damage to underground cables or pipes.
    4. To obtain permits from any authorities who are or may be concerned and to make application where necessary to the Planning Authority, Local Council, District Surveyor, Police, Fire Brigade and any similar authority or organisation. Any costs incurred in delays or modifications in the work arising from the absence or misrepresentation of all such necessary permissions and permits shall be payable to the Company by the Client.
    5. Where appropriate to obtain a licence from the Local Authority. Any requirements under the licence must be notified to the Company in writing, at least 28 days prior to erection. Should the Company for any reason be unable to comply with these requirements, then the Client shall be notified and the Contract shall be deemed to have been cancelled by the Client.
    6. If any part of the Equipment includes electrical apparatus to provide such power points or supply as may be reasonably required by the Company within 20 metres of the Equipment
    7. Not to enter the Equipment whilst it is being erected or dismantled by the Company.
    8. To keep any part of the Equipment completely closed and secure and in particular any door fastened when not in use
    9. Not to use any lighting, heating, cooking or other gas or electrical appliances of any kind without the prior written consent of the Company
    10. Not to light, or allow to be lit, any fire, candle or other naked flame within or close to the Equipment without the prior written consent of the Company
    11. Not to tamper with the structure or any part of the Equipment and in particular not to affix or suspend from the Equipment any item whatsoever without the Company’s prior written consent.
    12. No contact the Company immediately if you notice any unsecured parts of the structure.
  4. VARIATIONS

    The Hire Charge is based on the assumption that the Client provides a firm and level site of turf (or some other material not impervious to stakes and able to absorb rainwater) and is served by a firm access road adjacent to the site with adequate hard standing for commercial vehicles is free from flooding, trees and overhead obstruction. If this is not the case or if the Client wishes the Company to erect the Equipment in a different position on the site to the one indicated by the Client to the Company at the time of booking and in either event the costs to the Company are subsequently increased by reason of increase in labour costs or any other factor the Company may increase the price in accordance with the Company’s published price list and hourly labour rates then in force.

  5. LOSS OR DAMAGE OR EXCESSIVE SOILING
    1. The Client shall throughout the Period of Hire be responsible for the maintenance and safe custody of the Equipment.
    2. The Client must be satisfied with the Equipment before use and should notify the Company of any miscounts, incorrect deliveries or unacceptable Equipment before use.
    3. The Client shall be responsible for and indemnify the company against any loss of or damage to all hired equipment whatsoever the cause.
    4. The client must provide to the company proof of having arranged insurance in their name for the hired equipment at least 28 days prior to the delivery date of the equipment.
    5. If a Damage Waiver Fee is included on the Invoice then upon payment of the Damage Waiver Fee the above clauses 5c and 5d will not apply but the client will remain responsible for the first $1000 of any loss and for any loss or damage resulting from their negligence or legal liability.
  6. UNDERSTANDING
    1. The Hire Charge does not include making good any repairs to the Site unless caused by the negligence of the Company’s servants, agents or contractors.
    2. All sums payable under this agreement unless otherwise stated are exclusive of GST and other duties or taxes. Any GST or other duties or taxes payable in respect of such sums shall be payable in addition to such sums. 
  7. CANCELLATION
    1. Either party shall have the right to terminate this Contract without penalty within seven days from the date here of subject to written confirmation of such termination being given by one party to the other within such period. In the event of such termination by either party the Company shall refund to the Client all sums paid by the Client to the Company by way of deposit or otherwise.
    2. The full balance is required 28 days before the event. If you choose to cancel your booking please let us know ASAP. 
    3. If your cancellation is more than 28 days prior to your hire event we will refund your security deposit. 
    4. Cancellations within the 7 days of the hire date will forfeit the full balance and security deposit.
  8. EXCLUSION OF LIABILITY
    1. The Company will make every effort to complete the erection of the Equipment on or before the 
      Set Up date shown on the Run Sheet provided that the Client has complied with the undertakings set out above. If the Equipment is not erected on or before the Set Up date shown on the Run Sheet the Client shall have the right to withdraw and the Company shall return all monies paid. If the Equipment is not erected because of delays due to weather or other circumstances beyond its reasonable control the Company shall not be liable to pay further compensation to the Client.
    2. The Company will take all reasonable care to avoid damage to the Clients’ own equipment but cannot be responsible for any loss suffered by the Client in respect thereof other than as a result of the negligence of the Company’s servants, agents or contractors.
    3. The Company shall take no responsibility for or be forced to indemnify by the client, resulting from the failure to supply, breakdown, loss, theft or damage to ANY Third Party Equipment. This specifically includes generators, toilets and PA systems. Whilst Third Party Equipment might be included on the Company’s Booking Form it is agreed between the Company and the Client that the Company is exempt from any contractual obligation or indemnification resulting from breakdown, failure, theft or loss of equipment provided by a Third Party Suppler. The client will be provided with, sign in agreement and comply with the Terms and Conditions of Hire specific to the Third Party Equipment supplied by the Third Party Supplier.
  9. THIRD PARTY LIABILITY

    The Company will not be responsible for and the Client will indemnify the Company against all claims for the injury to persons or loss or damage to property howsoever caused unless it be proved that such injury or damage was caused by faulty material or workmanship or negligence on the part of the Company.

  10. DELIVERY
    1. The Client will be responsible for all delivery charges including petrol, tolls and labour in respect of the delivery and return of the equipment except when the period of hire is determined and the equipment is returned to the Company due to breakdown or failure caused solely by reasonable wear and tear and not by the hirer’s negligence or misuse or any other reason whatsoever. 
    2. Saturday delivery or collection: 10% surcharge on labour costs
    3. Sunday delivery or collection: 100% surcharge on labour costs
    4. If crew are required to stay overnight during delivery or over the course of event a subsistence fee of $250 per person per day will be charged to the client to cover cost for accommodation.
  11. Bookings & Cancellations
    1. Full payment is required 28 days prior to the event.
    2. To secure a Paddock Dreams Amenities booking a $200 security deposit is required upon booking.
    3. This $200 security deposit will be fully refunded into your account within 7 days after your event upon condition that there is no damage or extra cleaning required to the facilities.
    4. Should you choose to cancel your booking please let us know by email asap.
    5. If your cancellation is more than 28 days prior to your hire event we will refund your $200 security deposit 
    6. If your cancellation is less than 28 days of your hire event your security deposit will be forfeited.
    7. Cancellations within the 7 days of the hire date will forfeit the full balance and security deposit. 
  12. Facility Usage
    1. You are responsible for any damage and loss caused to the facilities regardless of culpability, and therefore if the security deposit is insufficient to cover costs incurred to Paddock Dreams Amenities, you agree to pay, in full, all rectification costs.
    2. No smoking is allowed inside the facilities
    3. You agree that Paddock Dreams Amenities or its employees accept no liability for any personal injury or damage to any persons or property suffered during the hire period or your usage
    4. It is the land owner’s obligation to ensure that event permits have been obtained through the appropriate council.
    5. Paddock Dreams Amenities is not responsible for obtaining any council or permits for its hire equipment.
    6. It is the land owner’s obligation to make sure all appropriate EPA guidelines are adhered too for shower and toilet hire. 
    7. It is the event holder’s responsibility to inform the appropriate council of any Paddock Dreams Event Hire equipment that will be installed on site.
